TERMS & CONDITIONS



You (“Member”) have read and understood the terms and conditions (“Terms”) as set out herein and agree to abide and be bound by the same. Volubilis Property Private Limited (“MYOS”, “Company”) reserves the right to change the Terms from time to time with the provision of notice to the User.

  1. Empanelment of Member is done location wise. In the event, the Member desires to enroll for more than one location, additional empanelment fee will apply.
  2. Members shall apply for renewal and shall pay the empanelment fee, before thirty (30) days of expiry of the initial tenure of the empanelment.
  3. The Company in its sole discretion may empanel the Member. In the event any of the information provided in the Empanelment Form is found to be incorrect, the Company shall terminate the membership of the Member without any liability to refund the empanelment fee.
  4. Member represents that all the information provided in the Empanelment Form is true and accurate and that the Member has all necessary licenses, permissions, consents as required under the applicable law to provide such services as specified by the Member in the Empanelment Form.
  5. MYOS acts only as a facilitator between its users and Members and shall not be held liable for any defective services provided by the Member to the user. MYOS does not provide any warranty to the Member with respect to engagement with its users for any project.
  6. Member shall keep the Company and each of its employees, representatives, officers, directors, agents and advisors (collectively the “Indemnified Party”), indemnified in full, against all third party claims, costs, expenses, damages and losses, including any interest, fines, legal and other professional fees and expenses awarded against or incurred or paid by the Indemnified Party arising out of or relating to the Member’s gross negligence or wilful misconduct, in the providing its services to the users, or breach of any of the representations, obligations of the Member under these Terms.
  7. These Terms shall be governed by and construed in accordance with the laws of the Republic of India. The Parties hereby irrevocably submits to the exclusive jurisdiction of the Courts at Hyderabad, Telangana, India.

  6. Member shall provide the information to MYOS of any transaction negotiated and closed between such Member and any of the user of MYOS. Member also provides the right to MYOS to use such information for the purpose of marketing, advertising of MYOS.

Member shall keep the Company and each of its employees, representatives, officers, directors, agents and advisors (collectively the “Indemnified Party”), indemnified in full, against all third party claims, costs, expenses, damages and losses, including any interest, fines, legal and other professional fees and expenses awarded against or incurred or paid by the Indemnified Party arising out of or relating to the Member’s gross negligence or wilful misconduct, in the providing its services to the users, or breach of any of the representations, obligations of the Member under these Terms.

You (“User”) have read and understood the terms and conditions (“Terms”) as set out herein and agree to abide and be bound by such terms and conditions with respect to provision of land guard services (“Services”). Volubilis Property Private Limited (“Company”) reserves the right to change the Terms from time to time with the provision of notice to the User.

  1. Enrolment for the Services

    • The User shall fill in the Application Form and provide accurate details of the Property along with the supporting documents such as proof of ownership, a copy of latest encumbrance certificate of the Property and such other documents as may be required. Upon the relevant information as required under these Terms and the Application Form being provided by the User, the Company shall scrutinize the same.
    • The Company shall have the right to go and inspect the Property physically, in the presence of the User or any authorized representative of the User, so as to verify the current status of the Property and shall report the same to the User. Such report shall also include information about any existing damage on the Property.
    • Only upon completion of the inspection as provided in clause 1.2 and upon the Company’s satisfaction with respect to the accuracy of the information and documents provided, the Company shall in its discretion, agree to perform the Services.
  2. Payment of Subscription Fee

    Upon completion of the enrolment process as provided under Clause 1, the Users shall pay the required fee (“Subscription Fee”) as detailed in the Application Form depending upon the Subscription Period opted by the User.

  3. Services

    • The Company shall appoint its authorized person (“Land Guards”) who shall visit the concerned property, the details of which are provided in this Form (“Property”) and provide the Services in accordance with the terms as specified herein.
    • During the period of subscription, as selected by the User in Point 7 of the Application Form (“Subscription Period”), the Land Guards shall visit the Property location once in every month and shall take pictures and videos of the concerned Property. The pictures or videos so taken by the Land Guards shall be geo-tagged and shall be provided to the User every month.
  4. Representations, Warranties and Covenants by the User

    • The User represents that the information provided in the Application Form is true and accurate;
    • The User represents that the User is the absolute owner of the Property;
    • In the event that the User holds the Property jointly with other person(s), the User has the consent from such other person(s) and shall provide the written consent of such other person(s) to the Company as part of the enrolment process.
  5. Disclaimer

    The Company’s Services shall be limited to providing monthly updates in the form of photographs and videos to the User and the Company shall in no case be held liable for any trespass, loss or damage caused to the Property by any third party. The Company shall also not be liable for any depreciation in the value of the Property for any reason whatsoever.

  6. Indemnity

    User shall keep the Company and each of its employees, representatives, officers, directors, agents and advisors (collectively the “Indemnified Party”), indemnified in full against all costs, expenses, damages and losses, including any interest, fines, legal and other professional fees and expenses awarded against or incurred or paid by the Indemnified Party as a result of breach of any of the representations, obligations of the User under these Terms.

  7. Limitation of Liability

    Notwithstanding anything contained in these terms, in no event shall the company be liable to the user, for any direct or indirect, punitive, special, incidental or consequential damages, including but not limited to, loss of income, profits or savings (whether under contract, strict liability, or tort, including negligence) arising out of or in connection with these Terms.

  8. Termination

    • Either party may terminate the relationship as provided herein by giving thirty (30) days prior written notice to the other Party.
    • The User shall immediately inform the Company of any change in the ownership or transfer of any interest in the Property. Upon such information, the Company shall have the right to terminate the engagement as provided herein.
    • The Subscription Fees paid by the User shall not be refunded if the User elects to terminate the Services of the Company under clause 8.1 or if the Company terminates the Services under clause 8.2, before the expiration of the Subscription Period.
  9. Governing Law and Jurisdiction

    These Terms shall be governed by and construed in accordance with the laws of the Republic of India. The Parties hereby irrevocably submits to the exclusive jurisdiction of the Courts at Hyderabad, Telangana, India.
